The Commission of the EU recently published an updated “Blue Guide”

This guide covers non-food and non-agricultural products referred to as industrial products or products for use by consumers or professionals. 

The updated version of the EU’s “Blue Guide to the Implementation of Product Regulations 2022” mainly provides a detailed explanation of the applicable regulations for toys, measuring instruments, radio equipment, low-voltage electrical equipment, medical devices and other product types. Furthermore, the Blue Guide also provides explanations and non-binding recommendations on how to deal with EU conformity assessment systems, CE marking requirements and market surveillance activities.  

There are also some elements of this guide that might be relevant for other Union harmonization legislation beyond the products listed above. In particular, Chapter 7 on market surveillance is relevant to the legislation listed in Annex I to Regulation (EU) 2019/1020.  

The new regulatory framework consists of a number of legal documents. In particular, Decision No. 768/2008/EC provides for elements that are partially or fully transposed into product-related Union harmonization legislation affecting various public interests. The Guide provides guidance on the implementation of the provisions and concepts of the new regulatory framework, as well as on the general application of the market surveillance provisions under Regulation (EU) 2019/1020.
