Five new substances to be included in the list of SVHC
The EU Commission published a draft regulation to include five new substances in the list of Substances of Very High Concern (SVHC).
The Draft Commission Regulation amends the Annex XIV to Regulation (EC) No 1907/2006 of the European Parliament and of the Council concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) which contains a list of SVHC.
The proposed substances are:
- 4,4′-bis(dimethylamino)-4”-(methylamino)trityl alcohol
- Reaction products of 1,3,4-thiadiazolidine-2,5-dithione, formaldehyde and 4-heptylphenol, branched and linear
- 2-ethylhexyl 10-ethyl-4,4-dioctyl-7-oxo-8-oxa-3,5-dithia-4-stannatetradecanoate
- Reaction mass of 2-ethylhexyl 10-ethyl-4,4-dioctyl-7-oxo-8-oxa-3,5-dithia-4-stannatetradecanoate and 2-ethylhexyl 10-ethyl-4-[[2-[(2-ethylhexyl)oxy]-2-oxoethyl]thio]-4-octyl-7-oxo-8-oxa-3,5-dithia-4-stannatetradecanoate
Producers, suppliers and importers must register their articles containing a certain concentration of the substances included list of substances of very high concern prior to placing on the market or the import to the EU.
REACH defines an article as an object which during production is given a special shape, surface or design that determines its function to a greater degree than its chemical composition. Examples of articles are clothing, flooring, furniture, jewellery, newspapers and plastic packaging. When new substances are added to the list, operators have six months to register their articles containing these substances to the authority.
The legal basis is the REACH Regulation EC 1907/2006 (Registration, Evaluation, Authorisation and Restriction of Chemicals), which has fundamentally harmonised chemicals legislation in the EU. It follows the principle of the industry’s own responsibility. This means that each entrepreneur must independently register his products falling within the scope of the regulation and may only distribute his products in the EU if he has a registration number.
