New Motor Vehicle Block Exemption Regulation?
The European Commission has launched a public consultation on the Motor Vehicle Block Exemption Regulation
The Commission Regulation (EU) No 461/2010 (the “Motor Vehicle Block Exemption Regulation”, MVBER) is currently the competition law framework for the automotive sector focusing on aftermarket issues. Among others, it contains rules on access to technical information for all independent operators, the freedom to source and supply spare parts, and the prevention of misuse of vehicle manufacturers’ warranty terms and related consumers rights.
The MVBER mandates the Commission to draw up an evaluation report on its operation by 31 May 2021, in view of its expiry on 31 May 2023. Therefore, the Commission launched a consultation with the objective to collect in-depth and high quality facts and evidence on the key competition issues arising in vertical relationships on the motor vehicle distribution and after-sales markets from the perspective of stakeholders.
Responses to the questionnaire can be provided on a dedicated website (link) until 25 January 2021.
