Denmark introduces packaging EPR

The proposal establishes similar measures to those issued by the EU Packaging Directive.

Focal point is the introduction of EPR requirements for packaging.

Based on the 2018 amendment to Directive (EC) No 94/62 on packaging and packaging waste, EU Member States are required to translate the legal obligations regarding EPR (extended producer responsibility) into national legislation until 31 December 2024.

Denmark has followed suit by proposing a standalone draft order on registration and reporting of packaging.  The producer shall report information on expected quantities of packaging placed on the market to the producer register organisation Danish Producer Responsibility (Dansk Producentansvar) and pay a fee for registration. Furthermore, the producer shall conduct self-checks on compliance and may join a collective scheme.

As such, this Danish law does not go beyond the requirements stated in the EU legislation. The rules on the actual organisation of the extended producer responsibility, however, will be introduced later in 2024. The draft Order shall enter into force on 1 April 2024 and can be retrieved here.
